PARTICIPANT WAIVER & ASSUMPTION OF RISK
TERMS AND CONDITIONS
Welcome to www.jordaanpilates.com- please take your time and read through these details carefully.
1. Participation at Own Risk
I confirm that I am voluntarily participating in Pilates classes provided by Jordaan Pilates (“the Instructor”). I understand that Pilates is a physical activity involving inherent risks, including but not limited to muscle strain, soft tissue injury, joint injury, aggravation of pre-existing conditions, or other physical harm.
I agree that I participate entirely at my own risk.
2. Health Declaration
I confirm that the information I have provided in the Jordaan Pilates health questionnaire is complete and accurate. I understand that it is my responsibility to inform the Instructor of any changes to my health, injury, pregnancy, or medical condition before attending class.
I confirm that I am physically able to participate, or that I have sought medical advice prior to taking part.
3. Instruction & Personal Responsibility
I understand that Pilates instruction may include mat-based exercises and the occasional use of small equipment (including, but not limited to, resistance bands, balls, blocks, or similar apparatus).
I accept responsibility for:
Working within my own physical limits
Following instructions as given
Modifying or stopping exercises if I experience pain, dizziness, or discomfort
Informing the Instructor immediately of any issue or injury
4. Assumption of Risk
I acknowledge that not all risks can be eliminated and that participation may result in injury without fault on the part of the Instructor. I knowingly and freely assume all such risks, both known and unknown, even if arising from the ordinary nature of Pilates exercise.
5. Release & Limitation of Liability
To the fullest extent permitted by UK law, I agree that Jordaan Pilates shall not be liable for any injury, loss, or damage sustained as a result of my participation. Jordaan Pilates is intended for your personal use in a group class or private class setting only, as a service to our customers and prospective customers. Jordaan Pilates cannot guarantee that Pilates is safe and proper for every individual. Jordaan Pilates makes no representations or warranties of any kind, express or implied, as to the operation of exercises, use of equipment or the information, images, materials, or products contained to Jordaan Pilates, including factual errors or omissions.
Any liability, loss, injury, or damage in connection with any use of Jordaan Pilates, including but not limited to any liability, loss, injury, or damage resulting from the performance of the exercises demonstrated here, or the advice and information given herein, is expressly disclaimed.
Users of Jordaan Pilates agree to hold Jordaan Pilates harmless from and against any and all claims, damages, costs, and expenses, including legal fees, arising from or related to your use of the exercises and or equipment.
I agree not to bring any claim against the Instructor for injury or loss arising from:
My failure to follow instructions
My failure to disclose relevant health information
My misuse of equipment
Normal and inherent risks of exercise
6. Venue Disclaimer (Church Location)
I acknowledge that classes are held at a third-party facility owned by a church, which is used solely as a hired venue. I understand that Jordaan Pilates operates independently and that the church does not organise, supervise, endorse, or take responsibility for the classes.
I agree that the church, its trustees, employees, and volunteers shall not be held liable for any injury or loss arising from my participation in Jordaan Pilates classes.
7. Emergency Medical Treatment
I consent to the administration of basic first aid or emergency assistance if required and accept responsibility for any costs incurred.
8. Acceptance of Terms
By booking and attending a class, I confirm that I have read, understood, and agreed to this waiver and the Jordaan Pilates Terms & Conditions.
9. Accountability
I agree to give at least 24 hours cancellation notice to Jordaan Pilates, and know that failure to do so will hold me accountable to pay the fee in full.
10. Health Cautions
Please note the following very important cautions before proceeding with any exercise program. Pilates is a low-impact form of exercise that has been shown to provide many beneficial health effects to those who practice it.
However, not all exercises are suitable for everyone, and Pilates exercises or any exercise program may result in physical injury. Consult with your doctor before embarking on any type of exercise program. To reduce the risk of injury, never force or strain during exercise. If you experience pain or discomfort during exercise, stop immediately and consult your doctor.
Certain special cautions apply to Pilates and all other exercise programs. For example, women who are menstruating should not practice inverted poses, back bends, or vigorous standing poses. Pregnant women should not practice twists or any abdominal tightening poses and should always have a note from their doctor to advise that they can indeed work out.
Other special cautions may apply to individuals with specific health issues. For that reason, before starting any kind of exercise program, you should consult your doctor to find out if any particular restrictions apply to you.
DISCLAIMER
I have read all the above information and understand the various risks associated with any exercise program, and it is still my choice to participate.
I have not withheld any relevant information regarding my physical condition, which may affect me during or following any session/s. I agree, the instructor is not responsible for any injuries sustained by me during my exercise session/s. I hereby release the instructor and studio/premises from any responsibility as all exercises are done at my own risk.
